It will be interesting to see how this thing plays out. MK is making an example out of one liquidator in order to put fear into others about liquidating or selling their items online. I really don't think they can ultimately be successful in this. However, it will be difficult for one liquidator to fight a large company like MK and their lawyers, financially that is. I am sure MK is also trying to find out who is selling the product to the liquidator as well.
On the other hand, for the MKC, they are also taking a chance that their whole scheme is going to be exposed. The way they load up consultants with product. If there wasn't so much product out there sitting in peoples garages, attics, basements, etc, then the liquidators could not exist. They have been boasting that they are the best selling brand but only to consultants, who are the ones who are buying it, not to the consumers! So, sales are great to new consultants and then the merchandise sits there in the closet! It looks like MK's chickens are coming home to roost! Are they really sure they want this all to come out?

They are suing for copyright infringement and they are unhappy about the fact that they list in Google. When people do a Google search on Mary Kay the liquidators come up too. Also, this particular liquidator is selling other products which they say will confuse the buyer into thinking these are also Mary Kay products. From what I read on that site a memo was sent out to all the Sales Directors saying they though long and hard about what to do about this and ultimately decided that they had no choice but to sue.

Because it could mean many things, like I said, type set used in the name, the actual use of the Mary Kay name or the selling of the product? I agree with what you said earlier that they won't win! lol It's not like they are making a product and then putting the MK name on it!!!!! Maybe we should all file a class action lawsuit against MKC for making it next to impossible to sell their crap!!!!!!

Touch of Pink advertises on Google Adwords as well (those little ads that come up on the top and right when you search on Google.) That makes them more visible. I suspect that having their own website, rather than just an eBay store, made a difference also. I was looking at the Touch of Pink site and beside the lawsuit to worry about, they have some SERIOUS inventory. Check out these numbers: - TimeWise night solution (discontinued formula) : 437 in stock
- Custom Compact (silver) : 367 in stock
- MK Signature eye color, Bamboo: 352 in stock
Holy cow they have a ton of stuff. Good luck getting rid of all that. By the way, Touch of Pink was never approved to be listed here as a liquidator because they pay consultants by money order and don't use PayPal. Don't know if that changed, but I never felt comfortable with the way they handled buying, even though I know there are people who had good luck with them.

Sorry, I meant to say Trademark infringement and instead wrote "copyright". If I remember correctly there are other liquidators that advertise on Google Adwords. And I don't believe they are the only liqudators that have their own website. I think I have seen others. I think the reason they are making an example of this one is because she was a consultant and was terminated by the company for selling product on eBay while she was an active consultant. They have a personal vendetta. The company probably thinks she is responsible for a lot of others now selling on eBay. MKC should look at themselves for the answer to that, IMO.
